Purchase Rules

 

General Provisions.

1.1. These rules for the purchase and sale of goods (hereinafter referred to as the "Rules") are a legally binding document for the parties, which establishes the rights and obligations of the Buyer and the Seller, conditions for purchasing and paying for the goods, procedures for the delivery and return of goods, liability of the parties, and other provisions related to the purchase and sale of goods in the "sildomosgrindys.lt" online store.

1.2. The Seller reserves the right to change, amend, or supplement the Rules at any time, taking into account the requirements established by legal acts.

1.3. The "sildomosgrindys.lt" online store operates not only within the territory of the Republic of Lithuania but also in Latvia and Estonia.

1.4. The "sildomosgrindys.lt" online store belongs to UAB Alera, company code 300099252, VAT code LT100004034615, registered address Geležinio vilko g. 11-73, Kaunas, Lithuania.

 

Moment of conclusion of the purchase and sale agreement.

2.1. The contract between the Buyer and the Seller is considered concluded from the moment the Buyer forms a shopping cart in the online store, specifies the delivery address, chooses the payment method, familiarizes themselves with the purchase rules, and confirms this by marking "Send Order".

2.2. Each purchase and sale contract concluded between the Buyer and the Seller is registered and stored in the "sildomosgrindys.lt" online store database.

2.3. After confirming the order in the online store, the Customer is immediately redirected to the order confirmation page and within 10 minutes from placing the order will receive an email with the confirmation and a unique order number assigned to them.

 

Buyer's rights.

3.1. The Buyer has the right to purchase goods in the "sildomosgrindys.lt" online store following these Rules and the procedure established by the online store.

3.2. The Buyer has the right to withdraw from the purchase and sale agreement concluded with the "sildomosgrindys.lt" online store by notifying the Seller in writing (by email, specifying the item to be returned and its order number) no later than 14 (fourteen) business days from the date of delivery of the item.

3.3. The return and exchange of goods are carried out in accordance with the "Rules for the return and exchange of items" approved by the order of the Minister of Economy No. 217 of June 29, 2001, and the "Rules for the sale of items and provision of services when contracts are concluded using means of communication" approved by the order of the Minister of Economy No. 258 of August 17, 2001.

Buyer's obligations and responsibilities.

4.1. By using the online store, the Buyer confirms that they agree with these purchase and sale Rules and must comply with them.

4.2. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules. In case the Buyer refuses to accept the goods at the time of delivery, the Buyer must pay the Seller for the delivery costs incurred.

4.3. The Buyer has no right to make claims to the Seller for delivering the goods to the wrong subject if the delivery address is incorrectly specified.

4.4. The Buyer is fully responsible for the accuracy of the data provided in the registration form.

4.5. The Buyer is responsible for actions performed using the online store, whether intentionally or unintentionally.

4.6. The Buyer is responsible for passing on their login data to third parties. If third parties use the Buyer's login data, the Buyer is responsible for the actions performed by the third party.

4.7. The Seller is released from any liability in cases where losses occur due to the Buyer's failure to familiarize themselves with these Rules, despite the opportunity provided, and not following the Seller's recommendations and their obligations.

 

Seller's rights.

5.1. If the Buyer attempts to undermine the stability and security of the online store or violates their obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer's ability to use the online store.

5.2. In significant circumstances, the Seller may temporarily or permanently terminate the operation of the online store without prior notice to the Buyer.

5.3. The Seller has the right to cancel the Buyer's order without prior notice if the Buyer fails to pay for the goods within 3 (three) business days, unless otherwise agreed.

5.4. The Seller has the right to unilaterally change the terms of promotions or cancel them without separate notice.

Seller's obligations and responsibilities.

6.1. The Seller undertakes to create all conditions for the Buyer to properly use the services provided by the online store.

6.2. The Seller undertakes to deliver the goods ordered by the Buyer to the specified address within 14 business days or within the agreed delivery period.

6.3. The Seller delivers the goods only after receiving the Buyer's payment via bank transfer or by agreeing that payment will be made in cash upon delivery of the goods.

6.4. In significant circumstances where the Seller is unable to deliver the ordered goods to the Buyer, the Seller undertakes to offer the Buyer an equivalent product, and if the Buyer refuses to accept the equivalent product, to return the money paid within 10 business days if the Buyer made an advance payment.

6.5. If the Buyer exercises the right to withdraw from the purchase and sale agreement within 14 (fourteen) business days from the date of delivery of the item, the Seller undertakes to return the money paid by the Buyer within 14 (fourteen) business days from the date of receipt of the returned item.

6.6. If the Buyer does not provide accurate data in the registration form, the Seller is not responsible for the consequences.

6.7. The Seller is not responsible for the fact that the goods in the online store may not match the actual size, shape, and color of the goods due to the Buyer's display settings.

Prices of goods, payment procedure.

7.1. The prices of the goods in the online store and in the generated order are indicated in euros with VAT.

7.2. The Buyer pays for the goods in one of the following ways:

7.2.1. Payment using electronic banking – this is an advance payment using the Buyer's electronic banking system. To use this payment method, the Buyer must have signed an electronic banking agreement with the bank and have their own account. When paying for the goods in this way, the Buyer generates a payment in the electronic banking system according to their order. The money is transferred to the "sildomosgrindys.lt" online store account in the chosen bank. Responsibility for data security in this case lies with the respective bank, as all financial operations take place in the bank's electronic banking system.

 

7.2.2. Payment by bank transfer – this is an advance payment where the Buyer prints the pro forma invoice of the order and transfers the money to the "sildomosgrindys.lt" bank account at the chosen bank branch.

7.2.3. Payment in cash upon delivery – the Buyer pays for the goods at the time of their delivery (handover – acceptance).

7.2.4. Payment by payment card – the Buyer pays for the goods with a VISA, Mastercard, or other payment card.

Product quality guarantee.

10.1. The Seller provides a quality guarantee for certain types of goods for a specified period, which is indicated in the descriptions of such goods.

10.2. The Seller does not provide warranty services for the goods, directing the Buyer to the warranty service center in each specific case.

 

Final provisions.

11.1. These rules are drawn up in accordance with the legal acts of the Republic of Lithuania.

11.2. The law of the Republic of Lithuania applies to the relations arising from these rules.

11.3. All disagreements arising from the implementation of these rules are resolved through negotiations. If an agreement cannot be reached, disputes are resolved in accordance with the procedure established by the laws of the Republic of Lithuania.
